Terms and Conditions

Thomas Mallorca Real Estate S.L. (hereinafter "Broker") arranges opportunities for the conclusion of contracts relating to all types of real estate, in particular residential and commercial buildings, developed and undeveloped land, apartments, villas, retail premises, offices, and commercial and industrial spaces in Mallorca.

1. Formation of the Brokerage Agreement

The brokerage agreement is concluded by a written agreement between the Broker and the Client. By entering into the brokerage agreement, the Client undertakes to pay the agreed brokerage commission upon the conclusion of a contract arranged or evidenced by the Broker (e.g. purchase agreement, lease agreement, rental agreement).

2. Offers and Liability

All offers made by the Broker are based on information provided by third parties. The Broker assumes no guarantee or liability for the accuracy or completeness of such information. Errors, prior sale, and interim letting are expressly reserved.

3. Disclosure of Information

If data and information provided by the Broker are passed on to third parties and a contract is subsequently concluded between the third party and the seller/landlord, the original recipient of the information shall be obliged to pay the customary or agreed commission.

4. Dual Agency

The Broker is entitled to act on behalf of both contracting parties for a commission (dual agency).

5. Entitlement to Commission

The entitlement to commission arises as soon as a principal contract regarding the named property has been concluded on the basis of the Broker's evidence and/or brokerage. If the principal contract is concluded under conditions other than those originally offered, or if it relates to another property of the evidenced contracting party, this shall not affect the entitlement to commission, provided the concluded transaction is economically identical to or only insignificantly different from the offered transaction (e.g. purchase instead of rental or vice versa).

6. Commission Payment

The commission becomes due upon conclusion of the principal contract (purchase/lease agreement) and is payable upon invoicing.

7. Confidentiality and Data Protection

All data and offers transmitted by the Broker are intended exclusively for the respective recipient and must be treated confidentially. Disclosure to third parties requires the prior written consent of the Broker. The Broker undertakes to treat all data received in the course of its activities confidentially, in particular personal data of clients. The processing of personal data is carried out in accordance with applicable data protection legislation.

8. Copyright

All photos, texts, and other content published on the Broker's website are protected by copyright. Use is only permitted with the prior written consent of the Broker.

9. Severability Clause

Should one or more provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that most closely reflects the economic purpose of the invalid provision.

10. Jurisdiction and Applicable Law

Spanish law shall apply. The place of jurisdiction shall be Palma de Mallorca, Spain, to the extent permitted by law.
